DMCA Copyright Policy

SaveCash ("SaveCash," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and have implemented the following policy to address claims of copyright infringement on our platform.

1. DMCA Safe Harbor

SaveCash is a service provider under the DMCA. We provide safe harbor protection for user-generated content that may be uploaded to our platform in accordance with 17 U.S.C. § 512. We act as an intermediary and do not review all content posted by users. However, we are committed to responding to valid DMCA notices and removing infringing content promptly.

Designated Agent: Our designated agent to receive notifications of claimed infringement is listed at the end of this policy. All DMCA notices must be sent to this designated agent to be effective.

2. Reporting Copyright Infringement

If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be effective, your notice must include all of the following information:

  • Physical or Electronic Signature: A signature (physical or electronic) of the copyright owner or a person authorized to act on their behalf
  • Identification of Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple works are covered, a representative list of such works
  • Identification of Infringing Material: A description of where the allegedly infringing material is located on our platform, including sufficient information (e.g., URL, screenshot) to allow us to locate the material
  • Contact Information: Your name, address, telephone number, and email address
  • Good Faith Statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • Accuracy Statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner

Warning: Knowingly submitting a false or misleading DMCA notice may result in liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

3. How to Submit a DMCA Takedown Notice

We recommend sending the notice via email for fastest processing. Please include all required information in your initial notice.

4. Our Response to DMCA Notices

Upon receipt of a valid DMCA takedown notice that substantially complies with the requirements above, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who posted the content that we have removed or disabled access to their content
  • Provide the user with a copy of the DMCA notice and information about how to submit a counter-notice

We typically process valid DMCA notices within 1-3 business days. In cases of repeat infringement or emergency situations, we may process notices more quickly. We reserve the right to remove content immediately if we determine, in our sole discretion, that it is clearly infringing.

5. Counter-Notice Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notice. To be effective, your counter-notice must include all of the following information:

  • Physical or Electronic Signature: Your signature (physical or electronic)
  • Identification of Removed Material: A description of the material that was removed or disabled and the location where it appeared before removal
  • Good Faith Statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Contact Information: Your name, address, telephone number, and email address
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court in which your address is located (or, if outside the United States, the jurisdiction of the United States District Court for the Northern District of California), and that you will accept service of process from the person who filed the original DMCA notice or their agent

Send your counter-notice to our designated agent at the address provided above. After we receive a valid counter-notice, we will:

  • Forward the counter-notice to the original complainant
  • Inform them that we may restore the removed content in 10 business days
  • Restore the content within 10-14 business days unless the original complainant files a court action seeking a court order to restrain you from engaging in infringing activity

6. Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We define a "repeat infringer" as a user who has been the subject of:

  • Two or more valid DMCA takedown notices, or
  • One valid DMCA takedown notice and other evidence of repeated copyright infringement

We maintain records of DMCA notices and may, at our sole discretion, terminate accounts or restrict access to our services for users who engage in repeated copyright infringement, even if counter-notices are filed or disputes are resolved in the user's favor.

7. False or Misleading Notices

LIABILITY FOR FALSE CLAIMS: Any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

We reserve the right to pursue legal action against individuals who submit false, misleading, or abusive DMCA notices or counter-notices, including claims for defamation, abuse of process, and violation of our Terms of Service.

8. Trademark Infringement

This policy addresses copyright infringement claims under the DMCA. For trademark infringement claims, please contact us at legal@savecash.com with the following information:

  • Your name and contact information
  • Description of the trademark and registration information (if applicable)
  • Description of where the allegedly infringing material appears on our platform
  • Evidence of confusion or likelihood of confusion
  • Your good faith statement that the use is not authorized

9. International Copyright Protection

While the DMCA is a U.S. law, we respect international copyright laws and treaties. Copyright owners outside the United States may submit notices that substantially comply with the DMCA requirements, or may submit notices under their local copyright laws. We will evaluate all notices on a case-by-case basis and take appropriate action consistent with applicable law.

10. Universal Legal Shield Provisions

Limitation of Liability

To the maximum extent permitted by law, SaveCash and its affiliates, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to DMCA notices, counter-notices, content removal, or this DMCA Policy, regardless of legal theory, even if SaveCash has been advised of the possibility of such damages.

SaveCash's total cumulative liability for any claim arising from or relating to this DMCA Policy or DMCA-related actions shall not exceed the greater of: (a) the amount you paid, if any, to use the Services during the six-month period preceding the claim; or (b) one hundred U.S. dollars (US $100).

Disclaimer of Warranties

Our DMCA procedures and content moderation services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. SaveCash disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and any warranties arising out of course of dealing or usage of trade.

Indemnification

You agree to defend, indemnify, and hold harmless SaveCash and its affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your submission of false, misleading, or abusive DMCA notices or counter-notices; (b) your violation of this DMCA Policy; (c) your infringement of third-party copyrights or intellectual property rights; or (d) any content you upload or post on our platform.

Governing Law and Dispute Resolution

This DMCA Policy and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising from or relating to this DMCA Policy or DMCA-related actions (other than DMCA counter-notice procedures which are governed by federal law) shall be resolved exclusively through binding arbitration under the rules of JAMS (or, if JAMS is unavailable, the American Arbitration Association) in San Francisco County, California, United States. The language of arbitration shall be English. You waive any right to participate in a class action, representative action, or jury trial.

Force Majeure

SaveCash shall not be liable for any failure or delay in processing DMCA notices or responding to takedown requests caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, labor conditions, Internet failures, cyberattacks, government actions, changes in laws or regulations, or any other cause beyond SaveCash's reasonable control.

Severability and Survival

If any provision of this DMCA Policy is found invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. All provisions that by their nature should survive termination shall survive, including warranty disclaimers, indemnity, and limitations of liability.

Entire Agreement and No Waiver

This DMCA Policy, together with our Terms of Service, Privacy Policy, and other referenced policies, constitutes the entire agreement between you and SaveCash regarding DMCA procedures and copyright matters and supersedes any prior agreements. Failure by SaveCash to enforce any right or provision shall not be deemed a waiver of such right or provision.
